Effective Disciplinary Investigations

Conducting an internal disciplinary investigation effectively requires skill and tact. This one day course will show HR practitioners, line managers and counter fraud staff how to fulfil their obligation to investigate disciplinary complaints into employee misconduct prior to any disciplinary action. It will also demonstrate how to gather evidence to the criminal standard in cases of suspected criminal activity. There is a further option to combine this programme with our Conducting Effective Disciplinary Interviews course.

Conducting Effective Investigative and Disciplinary Interviews

Investigative and disciplinary interviews need to be planned and executed with care if your evidence is to be used as the basis for disciplinary action or if you wish such evidence to be admissible in further civil or criminal proceedings. This one day course will provide internal investigators with the opportunity to develop and practise generic interviewing skills and establish how to avoid some of the common errors. This course may be combined with Effective Disciplinary Investigations. Although this course will focus on interviews in relating to employee misconduct with a view to taking disciplinary action, the role and function of PACE 1984 will also be briefly covered.

Cognitive Interviewing Skills

Cognitive Interviewing is a method of interviewing witnesses using a proven series of memory retrieval techniques which aim to increase the amount of information that can be obtained from a witness. Cognitive interviewing is therefore an ideal tool for investigating officers. The main benefit of cognitive interviewing is that it can obtain up to 40% more relevant information in relation to a specific event or incident. This means investigators will be able to take statements and prepare cases based on full accurate facts, even if the event happened months or years ago. Cognitive interviewing is a truly powerful tool which can cut down the amount of time interviews take and eliminate the need for costly re-interviews.

Interviewing Under Caution

Understanding the importance of how to interview under caution is an essential skill for any corporate investigator. Poor interviewing technique can mean investigators are unable to maximise their opportunity to gather evidence and build a compelling case. This can be easily avoided by knowing how to avoid the common pitfalls.

At the end of the course participants will know how to structure an interview and employ appropriate questioning and listening skills. Furthermore guidance will be provided to ensure interviews are conducted in compliance with PACE, the associated Codes of Practice and The Human Rights Act. This course can incorporate the use of a Neal Tape Recorder

PACE & Criminal Investigations

This course will show investigators how to conduct and manage a criminal investigation within a corporate environment. Hours of painstaking work could be lost due to a straightforward procedural error and this can be easily avoided.

At the end of the course delegates will be able to describe the requirements of The Police & Criminal Evidence Act 1984, identify information which should be contained in a witness statement, conduct a criminal investigation and interview a potential defendant in compliance with the legislation.

A significant amount of human interaction is non-verbal.
Your body language and tone of voice will have as much effect on the audience as the words you use.
It has been estimated that only about 7% of the meaning of a communication is derived from the words. Of the rest, about 38% is based on tone of voice and a massive 55% from the speaker's body language (which includes facial expression). This is based on research conducted by Albert Mehrabin in the 1960s.
It can be therefore be concluded that the messenger is as important as the message - or to put it another way 'people buy people'.
